Terms and conditions

What we owe you (a correctly drafted German document from your entries) and what we deliberately do not: advice on your individual case.

Who you are contracting with

Benjamin Baltruschat, Pasewaldtstraße 12, 14169 Berlin, Germany, kontakt@formundfrist.de. A sole trader, not a law firm, not a public authority and not an advice service.

What we owe you

Conclusion of the contract, price and payment

The contract is concluded when you click the order button and your payment is confirmed. The price is shown on the product page and again before you pay; it is a one-off price, with no subscription and no account.

As a small business within the meaning of § 19 of the German VAT Act (Kleinunternehmerregelung), we do not charge VAT. The price shown is the final price.

Payment is processed by Stripe Payments Europe Ltd. We never see your full card details.

Delivery and availability

Your files are generated immediately after payment and are available for 30 days through the download link we email you. Save them within that period. If a download fails, write to kontakt@formundfrist.de and you will get it again.

Right of withdrawal

You have a right of withdrawal as a consumer. Because we supply digital content, it can expire early: see our instructions on withdrawal.

Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only for the breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place, and only up to the foreseeable damage typical for this kind of contract.

We do not accept liability for the outcome of your matter. Whether a landlord pays, an employer accepts a notice or an authority agrees depends on facts and on the individual case, and neither a document nor a deadline calculation can guarantee it.

Applicable law, language and dispute resolution

German law applies, without prejudice to the mandatory consumer protection provisions of the country in which you have your habitual residence. The contract language is German.

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

Which version counts

This English text is provided so that you can understand the terms of your purchase. The German version is the legally binding one, and German law applies to the contract. You will find it at formundfrist.de/widerruf, /agb and /datenschutz.
